Terms of Service

These Terms of Service (“Terms”) are an agreement between you and Jamigo, LLC (“Jamigo,” “we,” “us”). They govern your use of Jamigo — our website at jamigo.io and the Jamigo app, including on the web (together, the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Who can use Jamigo
- You must be at least 16 years old. If you are under 18, or under the age of majority where you live, you may use Jamigo only with the permission of a parent or legal guardian, who agrees to these Terms on your behalf and is responsible for your use of the Service.
- You need a mobile phone number that can receive text messages. Jamigo currently supports U.S. mobile numbers.
- One person, one account. Use your own phone number, keep your profile truthful, and do not share your account or impersonate anyone.
2. Your account
You are responsible for what happens on your account and for keeping your phone and phone number secure, because the codes we send to that number are how you sign in. If you think someone else has accessed your account, or you lose access to your number, contact us at support@jamigo.io.
3. Text messages (SMS)
Jamigo, LLC (“Jamigo”) is the brand and sender of the text messages described in this section.
- What we send. When you enter your mobile number and tap “Text me a code” (“Mándame el código” in Spanish), Jamigo sends you an automated text message with a one-time code for account verification and sign-in.
- Transactional only. These messages are transactional, not marketing. Jamigo does not send marketing or promotional text messages.
- How often. Message frequency varies based on your sign-in and account activity — usually one message each time you ask for a code.
- Cost. Message and data rates may apply.
- Opting out. Reply STOP to any message from Jamigo to stop receiving text messages. Because your phone number is how you sign in, opting out may prevent phone-based sign-in and account verification.
- Help. Reply HELP for help, or email support@jamigo.io.
- Delivery. Text messages are delivered by wireless carriers, and delivery is not guaranteed. Carriers are not liable for delayed or undelivered messages.
Jamigo does not sell or share SMS opt-in data, consent information, or mobile phone numbers with third parties for marketing or promotional purposes. See our Privacy Policy.
4. How Jamigo works
Jamigo helps musicians, bands and the people who hire them find each other, agree on work and coordinate gigs. Agreements for gigs, sessions, jobs and gear sales are between the people who make them. Jamigo is not a party to those agreements and is not an employer, booking agent, manager or talent agency. We do not guarantee that any gig, booking, sale, payment or collaboration will happen or go as planned, and we do not verify everything members say about themselves.
You are responsible for your own agreements — including pay, cancellations, taxes, permits and licenses — and for your conduct and safety at gigs, rehearsals and meetings. Use good judgment when meeting people in person, and meet in a public place to buy or sell gear.
Payments. Jamigo does not currently process payments. The Service can show what people agreed to, but payment happens directly between the people involved, and Jamigo is not responsible for it. If we add payment features, additional terms will apply to them.
Reviews and reputation. Reviews must be honest and about a gig both people actually played. Reputation on Jamigo reflects activity on the Service; it is not a recommendation or guarantee by Jamigo. We may remove reviews that break these Terms.
5. Your content
You keep ownership of what you post, upload or send on Jamigo — photos, recordings, videos, messages, set lists, reviews and everything else (“your content”).
You give Jamigo a worldwide, non-exclusive, royalty-free license to host, store, copy, adapt (for example, to resize, compress or re-encode media) and display your content to the people you share it with, only as needed to operate and provide the Service. This license ends when your content is deleted from the Service, except for content that stays visible to others as described in our Privacy Policy (such as messages you sent in a conversation), copies we must keep by law, and copies that remain in backups for a limited time.
You are responsible for your content and confirm that you have the rights to share it. Do not upload anything you do not have the right to share, including copyrighted recordings, backing tracks, lyrics or sheet music. We may remove content or limit features when we believe content breaks these Terms or the law. We do not review content before it is posted and are not responsible for content posted by members.
6. What is not allowed
Do not use Jamigo to:
- harass, threaten, bully or discriminate against anyone;
- post content that is illegal, hateful or sexually explicit, or that exploits or endangers minors;
- spam, scam or mislead people — including fake gigs, fake reviews, or misrepresenting your identity, skills or availability;
- impersonate anyone, or create or use accounts on someone else’s behalf without their permission;
- share other people’s private information, such as addresses or phone numbers, without their permission, or use location sharing or contact details to track or contact someone for purposes unrelated to the gig;
- access or try to access other people’s accounts, messages, locations or data, or get around security or access controls;
- scrape or collect data from the Service by automated means;
- interfere with or disrupt the Service, or reverse-engineer it except where the law allows; or
- break any law.
7. Copyright complaints
If you believe content on Jamigo infringes your copyright, email support@jamigo.io with a description of the work, where the content appears on Jamigo, your contact information, and a statement that you believe in good faith that the use is not authorized. We will review it and may remove the content. We may close the accounts of members who repeatedly infringe.
8. Ending your use of Jamigo
You can stop using Jamigo at any time and delete your account in the app under You → Account and privacy. We may suspend or end your access if you break these Terms, if the law requires it, or to protect members or the Service. The parts of these Terms that by their nature should continue — including the license for content that remains on the Service, the disclaimers, the limitation of liability, the indemnity and the governing law — continue after your account ends.
9. Changes to the Service
Jamigo is in active development. We may add, change or remove features, and the Service may sometimes be unavailable.
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, JAMIGO DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.
We do not promise that the Service will be uninterrupted, secure or error-free, and we are not responsible for the conduct of any member or for any gig, booking, sale or other arrangement between members.
11. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, JAMIGO AND ITS OWNERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS. JAMIGO’S TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (US$100) OR THE AMOUNT YOU PAID JAMIGO IN THE TWELVE MONTHS BEFORE THE CLAIM.
Some jurisdictions do not allow these limitations, so some of them may not apply to you.
12. Indemnity
You agree to indemnify and hold harmless Jamigo, LLC and its owners, employees and agents from claims, losses and expenses, including reasonable attorneys’ fees, arising from your content, your use of the Service, your agreements or dealings with other members, or your violation of these Terms or the law.
13. Governing law
These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws rules. Any dispute arising from or relating to these Terms or the Service will be brought in the state or federal courts located in Colorado, and you and Jamigo consent to their jurisdiction.
14. Changes to these Terms
We may update these Terms. When we do, we will change the effective date at the top, and if the changes are significant we will let you know, for example with a notice in the app. If you keep using the Service after the changes take effect, you accept the updated Terms.
15. General
These Terms and our Privacy Policy are the entire agreement between you and Jamigo about the Service. If any part of these Terms cannot be enforced, the rest stays in effect. If we do not enforce a part of these Terms, that is not a waiver. You may not transfer these Terms without our consent; we may transfer them in connection with a merger, acquisition or sale of assets.
